Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to sell our products to you.

THESE TERMS

These Terms of Service apply when you visit our website or place an order with us. Please read them together with our Privacy Policy, Shipping Policy and Return and Refund Policy.

By using this website or placing an order, you agree to these terms. Nothing in these terms affects your statutory rights under UK consumer law.

You must be at least 18 years old to place an order, or have permission from a parent or legal guardian.

PRODUCTS

We take reasonable care to describe and display our products accurately. However, colours and appearance may vary slightly depending on your device and screen settings. Product packaging may also change without notice.

All products are subject to availability. We may limit quantities or withdraw a product from sale at any time.

ORDERS

When you place an order, you are offering to purchase the selected products. You will receive an email acknowledging your order, but this does not mean that we have accepted it.

Your order is accepted when we send confirmation that it has been dispatched. If we cannot accept your order, we will tell you and refund any payment taken.

We may refuse or cancel an order if a product is unavailable, the price or description was clearly incorrect, we cannot authorise payment, we suspect fraud or misuse, or we cannot deliver to the address provided.

Please check your order and delivery details carefully before submitting them.

PRICES AND PAYMENT

All prices are displayed in pounds sterling (GBP) and include applicable taxes unless stated otherwise.

Delivery charges are shown during checkout before you confirm your order.

Payment must be made using one of the payment methods offered at checkout. Payments are processed securely by Shopify Payments, PayPal or another displayed payment provider. We do not store your full payment-card details.

If we discover an obvious pricing error after you order, we will contact you before dispatching the goods. You may confirm the order at the correct price or cancel it for a full refund.

DELIVERY

We currently deliver within the United Kingdom only.

Standard delivery costs £3.99 and is free on orders of £50 or more. Orders are normally delivered within 3–5 working days from the date the order is placed.

Delivery times are estimates and may occasionally be affected by courier delays, severe weather, bank holidays or circumstances outside our reasonable control.

Some products may be dispatched directly from our supplier. Orders containing multiple products may arrive in separate parcels at no additional delivery charge.

Responsibility for the goods remains with us until they are delivered to you, or to a person you have nominated to receive them.

CANCELLATIONS, RETURNS AND REFUNDS

You normally have the right to cancel an online order without giving a reason. You must notify us within 14 days beginning the day after you receive the goods. After notifying us, you have a further 14 days to return them.

For change-of-mind returns, you are normally responsible for the direct return-postage cost. We will refund the product price and the cost of our least expensive standard delivery option where required by law.

We may make a reasonable deduction if goods have been handled beyond what is necessary to inspect them and their value has been reduced.

The right to cancel may not apply to personalised or custom-made products, perishable goods, or sealed goods that are unsuitable for return for health or hygiene reasons once unsealed.

FAULTY, DAMAGED OR INCORRECT GOODS

You are entitled to products that are of satisfactory quality, fit for purpose and as described.

If an item arrives damaged, faulty or incorrect, please contact us as soon as reasonably possible at hello@thecosycairn.co.uk. Photographs may help us investigate quickly.

Nothing in these terms limits your rights to a repair, replacement, price reduction or refund where provided by UK consumer law.

INTELLECTUAL PROPERTY

The website’s original text, images, branding, graphics and design are owned by or licensed to The Cosy Cairn and are protected by applicable intellectual-property laws.

You may use the website for personal, non-commercial purposes. You must not copy, reproduce, distribute, sell or exploit our content without written permission, except where permitted by law.

Shopify’s names, logos and services belong to Shopify and its licensors.

THIRD-PARTY SERVICES AND LINKS

Our website may contain links to third-party websites or use services supplied by third parties, including payment providers and delivery companies.

We are not responsible for the content or privacy practices of third-party websites. Please review their terms and policies before using them. Nothing in this section removes any responsibility that we cannot lawfully exclude.

PRIVACY

We process personal information in accordance with our Privacy Policy and applicable UK data-protection law.

Shopify also processes certain information to operate the ecommerce platform. Further information is available in Shopify’s privacy policy.

ACCEPTABLE USE

You must not misuse this website, introduce viruses or malicious code, attempt unauthorised access, interfere with the website’s security, use automated systems in a harmful manner, or use the website for unlawful or fraudulent purposes.

We may suspend access where reasonably necessary to protect the website, our customers or our legal rights.

LIABILITY

We are responsible for loss or damage that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.

We are not responsible for loss or damage that was not reasonably foreseeable, or for business losses where you are purchasing solely as a consumer.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded. Nothing affects your statutory consumer rights.

EVENTS OUTSIDE OUR CONTROL

We are not responsible for delay caused by events outside our reasonable control. If this happens, we will take reasonable steps to minimise the delay and keep you informed.

This section does not affect any statutory right you may have to cancel an order or receive a refund.

CHANGES TO THESE TERMS

We may update these terms when our services, business practices or legal obligations change. The terms applying to your purchase will be those available when you placed your order, unless a change is required by law.

GOVERNING LAW

These terms are governed by the laws of Scotland.

If you live in Scotland, legal proceedings may be brought in the Scottish courts. If you live elsewhere in the United Kingdom, you may bring proceedings in the courts of the part of the United Kingdom where you live, or in the Scottish courts.
